These Terms of Use & Services (“Terms”) form a legally binding agreement between Your Care Training Solutions Ltd. (Company Number 16647876), trading as Your Care Training (“we”, “us”, “our”) and any person (“you”, “your”, “learner”, “client”) who accesses our website (yourcaretraining.com), books training, or uses our services. By enrolling in or purchasing our courses, you confirm that you have read, understood, and agree to these Terms.

1. Scope of Services

We provide training services tailored to the UK Health & Social Care sector, including but not limited to:

  • Classroom-based training
  • Practical skills sessions
  • Online learning modules (eLearning)
  • Blended learning (combination of online and in-person)
  • Custom in-house training for organisations

Our trainers are fully qualified and accredited to deliver training. Unless explicitly stated in writing, our courses themselves are not accredited qualifications, but they are designed to meet recognised sector standards where applicable.

2. Eligibility

You must be 18 years or older to book a course directly. Learners under 18 may attend only if booked by an employer, parent, or guardian. You confirm that all details provided are accurate, complete, and kept up to date.

3. Booking & Payment

  • All bookings must be made through our website or via an authorised representative.
  • Payment must be received in full before training access is granted.
  • We accept secure online payment methods and bank transfers.
  • We reserve the right to refuse any booking at our discretion.

4. Strict Refund & Cancellation Policy

All course sales are final. We operate a strict no-refund policy once payment has been processed. This applies to all training types (in-person, online, virtual classroom).

Exceptions:

  • If we cancel or reschedule a course, you will be offered a full refund or a free transfer.
  • For in-person training, you may transfer to another date if you notify us at least 14 days in advance, subject to a £25 admin fee.
  • Online courses are non-refundable once login details are issued, in line with the Consumer Contracts Regulations 2013, Regulation 28(1)(b).

Failure to attend or complete a course will not entitle you to a refund or reschedule.

5. Learner Conduct & Behaviour

  • You must behave respectfully towards trainers and other learners.
  • Discriminatory, abusive, or disruptive behaviour will result in immediate removal without refund.
  • You must follow all health & safety instructions during practical training.

6. Access to Online Platforms

For eLearning and virtual training, you are responsible for maintaining your login security. Sharing accounts or course materials without written permission is prohibited.

7. Intellectual Property

All course materials, including text, images, videos, assessments, and branding, are our intellectual property or used under licence. You may use them for personal learning only. Reproduction, distribution, or public display without written consent is forbidden.

8. Accuracy & Disclaimer

While we take care to provide accurate and up-to-date training, our courses are for educational purposes only. You are responsible for applying knowledge in line with your workplace policies, sector regulations, and applicable laws.

9. Compliance Responsibilities

We do not guarantee that completion of a course will meet all legal or regulatory requirements for your role. Employers remain responsible for ensuring their staff meet all statutory training obligations.

10. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential losses.
  • Our total liability will not exceed the amount paid for the specific course.
  • We accept no responsibility for loss arising from misuse of our training materials.

11. Data Protection & Privacy

We process personal data in line with our Privacy Policy and Cookie Policy. Special category data (e.g., health information) is processed only with consent and retained only as long as necessary.

12. Third-Party Services

We may use third-party platforms for course delivery, payment processing, or certification. We are not responsible for service interruptions or failures caused by these providers.

13. Force Majeure

We are not liable for failure to deliver training due to events beyond our reasonable control, including natural disasters, strikes, power outages, pandemics, or technical failures.

14. Changes to Services & Terms

We reserve the right to modify our services, pricing, or these Terms at any time. The latest version will always be published on our website. Continued use of our services constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be resolved exclusively in the courts of England and Wales.

17. Waiver & Risk Acknowledgement (Practical Training)

By enrolling in any course that includes practical training (including but not limited to First Aid, Moving & Handling of People, or Medication Administration), you acknowledge and agree to the following:

  • You understand that practical training may involve physical activity and demonstration of techniques.
  • You agree to participate at your own risk and confirm that you are physically able to take part in the training.
  • You agree to follow all trainer instructions, health & safety protocols, and use of equipment provided.
  • You accept full responsibility for any injury or discomfort sustained as a result of failure to follow instructions or unsafe actions.
  • We will not be liable for any injury, loss, or damage caused by your own negligence, failure to disclose relevant health conditions, or disregard for safety advice.

If you have any medical conditions, injuries, or disabilities that may affect your participation, you must inform us and/or the trainer prior to the start of the course. We may, at our discretion, make reasonable adjustments or recommend alternative arrangements to ensure your safety.
